These terms apply to all bookings and services provided by Visual Elevation, a trading name of Dion Pereira, sole proprietorship registered with the Dutch Chamber of Commerce (KvK) under number 66050936, VAT number NL001563724B93, based in Dordrecht, Netherlands (“we”, “us”, “Visual Elevation”).
1. Services
Visual Elevation provides aerial drone photography and videography services for villas, hotels, resorts, real estate, tourism, construction, and commercial clients (“the Client”), as agreed in a quote, proposal, or written confirmation for each project.
2. Quotes and bookings
- Quotes are valid for 30 days unless stated otherwise.
- A booking is confirmed once the Client accepts the quote and pays the deposit described in section 3.
- We reserve the right to decline a booking, including where the location or request falls outside applicable drone regulations.
3. Payment
- A deposit of 50% of the total project fee is due to confirm a booking.
- The remaining balance is due within 14 days of delivery of the final content, unless otherwise agreed in writing.
- Late payment may incur statutory interest and reasonable collection costs under Dutch law.
- Prices exclude VAT unless stated otherwise.
4. Rescheduling and cancellation
- Weather and flight safety: drone operations depend on legal and safe flying conditions. If a shoot cannot go ahead due to weather, airspace restrictions, or safety, we will reschedule at no additional cost.
- Client-initiated cancellation, more than 14 days before the scheduled shoot: full deposit refund minus any costs already incurred (e.g. travel booked).
- Client-initiated cancellation, within 14 days of the scheduled shoot: deposit is non-refundable.
- Rescheduling by the Client is accommodated where possible, subject to availability.
5. Delivery
- Final edited photos/videos are delivered within the timeframe agreed per project (typically 15 business days after the shoot, unless otherwise specified).
- Delivery format and platforms (e.g. website, social, listings) are agreed in advance.
6. Usage rights and ownership
- Visual Elevation retains copyright and ownership of all raw and edited footage/photography produced.
- Upon full payment, the Client receives a non-exclusive, worldwide license to use the final delivered content for the purpose agreed at booking (e.g. website, marketing, social media, listings).
- Any use beyond the agreed purpose (e.g. resale, sublicensing to third parties, use in a different business) requires separate written permission.
- Visual Elevation retains the right to use the final content for its own portfolio, marketing, and social media, unless the Client requests otherwise in writing before the shoot.
7. Guest and third-party appearances
- Where anyone other than the Client, including guests, staff, or other third parties, may appear identifiably in the footage (e.g. shoots on liveaboards, at resorts, hotels, or events), the Client is responsible for informing those individuals in advance and obtaining their signed consent for their likeness to be filmed and used in the final deliverables, before the shoot takes place.
- The Client will use a model/talent release form (either their own or the template Visual Elevation can provide on request) and will retain the signed releases, making copies available to Visual Elevation on request.
- Visual Elevation does not verify that consent has been obtained and is not liable for any claim arising from a missing or invalid release.
- If a required release is not in place, Visual Elevation reserves the right to edit the individual concerned out of the footage, delay delivery, or withhold the affected content, at the Client’s cost.
8. Drone operations and compliance
- All flights are conducted by a licensed drone pilot in compliance with applicable Dutch/EASA drone regulations.
- Visual Elevation holds third-party liability insurance for drone operations.
- We reserve the right to abort or refuse a flight at any time for safety, legal, or airspace reasons, without liability for resulting delay.
- It is the Client’s responsibility to secure any permissions required for the shoot location where these are not covered by general drone regulations (e.g. private property access).
9. Liability
- Visual Elevation is not liable for indirect, incidental, or consequential damages (e.g. loss of bookings or revenue) arising from the services.
- Our total liability for any claim is limited to the total fee paid for the project in question.
- Nothing in these terms limits liability that cannot be limited under Dutch law (e.g. liability for intent or gross negligence).
10. Force majeure
Neither party is liable for delay or failure to perform due to circumstances beyond reasonable control, including extreme weather, airspace closures, or government restrictions.
11. Governing law and disputes
These terms are governed by the laws of the Netherlands. Any dispute will be submitted to the competent court in the district where Visual Elevation is registered, unless mandatory consumer protection law provides otherwise.
12. Changes to these terms
We may update these terms from time to time; the version in force at the time of booking applies to that project.
